  • First-Degree Misdemeanors are punishable by up to one year in jail and up to a $1,000 fine.

Some examples of first-degree misdemeanors include driving under the influence (DUI), domestic violence, and simple battery.

  • Second-degree Misdemeanors are punishable by up to 60 days in jail and up to a $500 fine.

Some examples of second-degree misdemeanors include disorderly conduct, first-offense petty theft, simple assault, and criminal mischief.

For both first-degree and second-degree misdemeanors, the court may impose additional consequences, conditions, and restrictions such as probation, orders of protection, counseling, suspension of driving or professional licenses, loss of firearms rights, and community service.
